You have the right to opt out of the arbitration agreement within 30 days as described in Section 14(H). If you do not agree, do not use this Website.

4. Services and Scheduling
A. Service Descriptions
We make reasonable efforts to accurately describe our services. Service availability, pricing, and scope may vary. We reserve the right to modify, suspend, or discontinue any service at any time.
B. Scheduling and Appointments
Appointments scheduled through the Website or through our AI-assisted scheduling tools are subject to availability. We will make reasonable efforts to honor scheduled appointments but reserve the right to reschedule or cancel appointments due to technician availability, weather, or other circumstances beyond our control. We will provide notice of any cancellation or rescheduling as promptly as practicable.
C. Pricing
All pricing is in U.S. dollars and is subject to change. Final pricing for services may vary based on the scope of work assessed upon arrival. We will communicate any pricing adjustments before performing additional work.
D. Cancellations and Rescheduling
We understand that plans change. Here is how our cancellation and rescheduling policy works:
Cancellations:
- If you cancel more than 24 hours after booking but before the service window, a $25 cancellation fee applies.
- If you cancel within 24 hours of your scheduled service window, a $50 cancellation fee applies.
- If our technician arrives and no one is home, or if you cancel within 4 hours of your scheduled service window, the full cost of the service will be charged.
Rescheduling:
- You may reschedule your appointment at no charge up to 12 hours before your scheduled service window.
- If you reschedule within 12 hours of your scheduled service window, a $25 rescheduling fee applies.
Fees will be charged to the payment method on file. By booking a service, you agree to this cancellation and rescheduling policy.
5. Payments
We use Authorize.net through OctopusPro to process payment transactions. We do not collect, store, or have access to your payment card number, CVV, or other financial account credentials. All payment information is transmitted directly to and handled by Authorize.net. Authorize.net’s handling of your payment information is governed by its own terms and privacy policy, available at authorize.net.
6. Privacy and Data Collection
Your use of the Website is subject to our Privacy Policy, available at https://www.techsonsite.com/privacy-policy/. The Privacy Policy is incorporated into these Terms by reference and describes in detail:
- The categories of personal information we collect, including information collected automatically through tracking technologies.
- The third-party advertising and analytics platforms that may receive your data, including Google Analytics, and conditionally Meta, TikTok, Pinterest, and Snapchat based on active advertising campaigns.
- How data is transmitted to those platforms via browser-side pixels and server-side APIs where applicable.
- Your rights under applicable privacy laws, including the right to opt out of sharing your personal information for cross-context behavioral advertising.
- How to exercise your privacy rights, including through the Do Not Sell or Share My Personal Information link in the Website footer.
By using the Website, you acknowledge that you have reviewed the Privacy Policy. Your use of the Website does not constitute consent to tracking for advertising purposes; consent for non-essential tracking is obtained separately through the cookie consent mechanism described in the Privacy Policy.
7. AI-Assisted Services
Our service platform, OctopusPro, integrates with Goodcall, a third-party AI phone receptionist service that operates 24 hours a day, 7 days a week. Goodcall may access your scheduling information, appointment details, and other information stored in OctopusPro to respond to your inquiries, manage bookings, and answer routine questions on our behalf.
By scheduling a service or creating an account, you acknowledge that your scheduling and appointment information may be accessed and processed by Goodcall in connection with providing automated phone receptionist services. Goodcall’s handling of your information is governed by its own terms and privacy policy. We are not responsible for Goodcall’s data practices beyond our contractual arrangements with them.
OctopusPro also uses automated rules-based tools for dispatch, notifications, and accounting integrations, including QuickBooks and Xero. These automations process your service and contact information to deliver appointment reminders, technician ETA notifications, and invoicing updates via SMS, WhatsApp, and email.
8. Electronic Communications and Marketing
A. Transactional and Service Communications
By creating an account or scheduling a service, you consent to receive transactional and service-related communications from us and from our service platform OctopusPro, including appointment confirmations, technician ETA notifications, booking reminders, and invoicing updates delivered via email, SMS, and WhatsApp. These communications are necessary to deliver the service and are not subject to marketing opt-out.
B. Marketing Communications
We do not currently operate an email or SMS marketing program. If we introduce a marketing communications program in the future, we will obtain your separate, affirmative consent before sending any marketing communications and will update this policy accordingly.

The Website may contain links to third-party websites. Those websites are not operated or controlled by Techs On Site, LLC and we are not responsible for their content, privacy practices, or terms of use. We encourage you to review the privacy policy and terms of each third-party site you visit.
12. Disclaimer of Warranties
THE WEBSITE AND ALL CONTENT, SERVICES, AND INFORMATION AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY CONTENT ON THE WEBSITE.
Nothing in this Section limits or excludes any warranty that cannot be disclaimed under applicable law, including any rights you may have under New York or California consumer protection statutes or other applicable state or federal law.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TECHS ON SITE, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEBSITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE WEBSITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
The limitations in this Section do not apply to: (a) liability for death or personal injury caused by our negligence; (b) liability for fraud or fraudulent misrepresentation; (c) any liability that cannot be limited or excluded under applicable law, including liability arising under applicable consumer protection statutes or federal privacy laws; or (d) your indemnification obligations under Section 15.
14. Dispute Resolution — Binding Arbitration
A. Informal Resolution First
Before initiating arbitration, you agree to first contact us at support@techsonsite.com and describe your dispute in reasonable detail. We will attempt to resolve the dispute informally within 30 days. If we are unable to resolve the dispute informally within 30 days of your notice, either party may proceed to arbitration as described below.
B. Binding Arbitration
Except as provided in Sections 14(F) and 14(G) below, any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Website, our services, or our Privacy Policy shall be resolved by final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, available at adr.org. The arbitration shall be conducted by a single neutral arbitrator. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this arbitration provision.
C. Arbitration Location and Fees
Arbitration may be conducted by telephone, videoconference, written submissions, or in person at a location mutually agreed upon by the parties. Filing fees, administrative fees, and arbitrator compensation shall be allocated in accordance with the AAA Consumer Arbitration Rules.
D. Class Action Waiver
YOU AND TECHS ON SITE, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE ACTION OR PROCEEDING.
THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING. IF THIS CLASS ACTION WAIVER IS FOUND UNENFORCEABLE AS TO ANY CLAIM, THAT CLAIM WILL PROCEED IN COURT AND NOT IN ARBITRATION, AND THE REMAINING CLAIMS WILL PROCEED IN ARBITRATION ON AN INDIVIDUAL BASIS.
This class action waiver applies independently of and survives any invalidation of the arbitration agreement in Section 14(B). If a court determines the arbitration agreement is unenforceable, this class action waiver shall remain in effect to the maximum extent permitted by applicable law.
F. Public Injunctive Relief Carve-Out
Notwithstanding the arbitration agreement and class action waiver above, any claim seeking public injunctive relief — meaning injunctive relief that benefits the general public rather than primarily yourself — may be brought in a court of competent jurisdiction and shall not be subject to arbitration. Nothing in these Terms is intended to waive your right to seek public injunctive relief in court.
G. Small Claims Court
Either party may bring an individual claim in small claims court if the claim qualifies and is brought on an individual basis.
H. Opt-Out Right
You may opt out of this arbitration agreement by sending written notice to optout@techsonsite.com with the subject line “Arbitration Opt-Out” within 30 days of first accepting these Terms. Your notice must include your name, your email address, and a statement that you wish to opt out. Opting out does not affect any other provision of these Terms.
15. Indemnification
You agree to indemnify, defend, and hold harmless Techs On Site, LLC and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
- Your use of or inability to use the Website or services.
- Your violation of these Terms.
- Your violation of any third-party right, including any intellectual property right or privacy right.
- Your violation of any applicable law or regulation.
16. Governing Law and Jurisdiction
A. New York Law Governs Generally.
These Terms and any dispute arising out of or relating to them are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles, except as provided in Sections 16(B) and 16(C) below.
B. California Consumers.
If you are a resident of California, your rights under the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), the California Invasion of Privacy Act (CIPA), and any other California statute that confers rights on California consumers that cannot be waived by contract are governed by California law, regardless of the New York choice of law above. Nothing in these Terms limits, waives, or modifies any right you have under California law that is non-waivable by contract. All other aspects of these Terms remain governed by New York law.
C. Other State Statutory Claims.
If you are a resident of a state other than California that has enacted a consumer privacy law or other statute conferring rights that cannot be waived by contract, the law of your state of residence governs your claims under that statute to the extent New York law would deprive you of those non-waivable rights. All other aspects of these Terms remain governed by New York law.
D. Jurisdiction and Venue.
For any dispute not subject to arbitration under Section 14, you and Techs On Site, LLC consent to the exclusive jurisdiction of the state and federal courts located in Onondaga County, New York, except that California residents asserting California statutory claims may bring those claims in the appropriate California court, and residents of other states asserting non-waivable statutory claims may bring those claims in the appropriate court in their state of residence.
E. Federal Arbitration Act.
Notwithstanding the governing law provisions in this Section, the Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement and class action waiver in Section 14 in all circumstances and in all jurisdictions.
17. Data Breach Notification
In the event of a security breach involving your personal information, we will notify you as required by applicable law, including New York General Business Law § 899-aa and, where applicable, California Civil Code sections 1798.29 and 1798.82. Notification will be provided by email or by other means required or permitted by law.
18. Changes to the Website and Terms
We reserve the right to modify, suspend, or discontinue the Website or any portion of it at any time. We may also update these Terms at any time. For material changes, we will provide at least 14 days’ notice by posting a prominent notice on the Website or by email. Your continued use of the Website after the effective date of any update constitutes acceptance of the revised Terms.
19. General Provisions
A. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Techs On Site, LLC regarding your use of the Website and supersede all prior agreements and understandings.
B. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will continue in full force and effect.
C. Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
D. Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
E. No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.
